德國民法典之債法改革對中國未來民法典的啟示

內容提要
在原有債法缺陷的誘導以及歐共體指導條例、國際條約的推動下，德國民法典完成了自1900年實施以來的最大一次變革。以強調消費者保護思想與吸收對電子商務的規定為標志，于2002年1月1日生效的新民法典重新走在了21世紀的法典化運動的前沿。這次改革對于同樣在醞釀制定民法典的中國而言，其啟示就是必須要有國家的領導與組織、嫻熟的立法技術、充分的法典編撰以及恰當的時機。
Abstracts (英文摘要)
Based on the defects of the formerly law of obligations (Schuldrecht) und pushed forward by directives of the EU and international conventions, the German Civil Code (Bürgerliches Gesetzbuch) has fulfilled its largest Reform since its enforcement in 1900. In effect from January 1, 2002, the newly promulgated Civil Code plays a leading role in the codification movement of the 21st century thanks to its emphasizing on consumer protection and absorbing the regulation of E-commerce. The Enlightenment of the German Reform for China, which is considering to draft its own civil code, should be a strong political will and organization, skilled legislative technique, adaquate preparation for drafting the code as well as a proper time.
