Abstract: Withdrawal of charges which has abolished by revised The Criminal Procedure Law of China is an action of court hearing. It is say that the procuratorial organ hasn't the right of withdrawal of charges. But The Supreme People's Court and The Supreme People's Procuratorate given the right of withdrawal of charges to procuratorial organ newly through judicial interpretation of law. And the judicial interpretation of law has led judicial practice to trouble.
